South African Two-Pot Retirement System FAQs
Official rules, tax directive processes, and statutory limitations under the 2024 Revenue Laws Amendment Act
Unlike retirement lump sum withdrawals upon actual retirement (which use preferential cumulative retirement tax tables with a R550 000 tax-free bracket), pre-retirement savings component withdrawals are added to your normal annual taxable remuneration.
This means the withdrawal is taxed at your SARS marginal tax rate (from 18% up to 45%). Before any funds are paid to your bank, your fund administrator is legally obligated to apply to SARS for a Tax Directive. SARS calculates the exact tax withholding and returns the directive, which the administrator automatically deducts from your gross payout.
Yes, absolutely. When your fund administrator requests an electronic tax directive, SARS's automated IT88 system checks your tax profile.
If you have unpaid SARS tax assessments, administrative non-submission penalties, or debt arrangements, SARS will issue a directive ordering the administrator to garnish the debt directly from your savings pot payout. If your debt exceeds the net payout, you may receive R0.
Under statutory rules:
- Minimum withdrawal: R 2 000.00 gross. If your savings pot balance is less than R2 000, you cannot make a withdrawal until new contributions bring it to at least R2 000.
- Frequency: You are permitted exactly one withdrawal per tax year (the South African tax year runs from 1 March to 28/29 February).
- Maximum withdrawal: Up to 100% of your available savings pot balance.
No. Once a tax directive has been generated and approved by SARS, the withdrawal instruction is irrevocable under South African pension law. You cannot reverse the transaction, return the money to the savings pot, or refund the tax paid.
General rebates (Primary R17 235, Secondary R9 444, Tertiary R3 145) reduce your standard annual PAYE liability. If your annual remuneration is already above the tax threshold (R95 750 for under 65s), your annual rebates have already been fully utilized against your regular salary.
Therefore, the lump sum withdrawal is taxed dollar-for-dollar (rand-for-rand) at your top marginal rate without being shielded by rebates. If your normal salary is below the tax threshold, any unused portion of the rebate absorbs part of the tax liability.
